Family Reunion – Pakistan – General info for all to avoid mistakes

Dear Members Assalam-o-Alaikum,
I am writing this email to let members know few things about family reunion and some mistakes which must be avoided. If some friend is going to get married  in Pakistan, please tell him/her about these issues. Simple looking mistakes can cause big trouble and delay later in family reunion.
About Nikah Registration:
Registration of Nikah involves three people:  Nikah Khawan, Nikah Registrar  and Union council. UC gives a register with 50 leaves to Nikah-Registrar. Each leave contains Nikah Nama ” Form II” in quadruplicate. In one UC , only a single Registrar can have the register.  In usual case, Nikah Khawan goes to Registrar(if he is himself not a registrar) and gets a Nikah nama Form II (which has fours copies). One copy each (filled and signed) is given to  Duhla, Dulhan,Registrar and UC.
1. Take care that Nikah is registered at the same Union Council where Nikah has taken place .Address written on filled Nikahnama should be in the UC where Nikah is registered.  Any thing different to this created big problem for many ,especially those who did Nikha in a Marriage Hall and brought Molvi sahib from some other UC. If you made this mistake, count a delay of at least 3 months. Embassy will raise objection as the lawyer sent for Marriage verification would like to see your Nikah registered at the same UC as address written on Nikahnama. You may be to asked to change registration of your marriage from one UC to other through a court procedure in Pakistan.
2. Please closely check all the four copies of the filled Nikah-Nama for any mistake in names, ID card nr., date of birth etc. Check that all signatures are there at right place and stamp of Nikah-Registrar is present. Many take things lightly in Pakistan while filling forms.
3. Telephonic Nikah is big no no. You must be present there as German Embassy/consulate now checks it from entry and exit stamps on your passport. If there are some unavoidable circumstances, give a written power of attorney which has legal value i.e signed in front of Notary Public/judge or from Pakistani embassy/consulate (in case they deal with it) to your father to represent you during Nikah.  Better be present there. Your absence will complicate the matters and hence the delay/rejection as a consequence.
4.  Carefully read the requirements of Embassy for Family reunion. If any question arises, call embassy to get an answer. Don’t rely blindly on the info collected from here and there.
5. Some people I talked to have made mistake while getting online appointment. You mad a mistake in name, passport number or email address than most probably you will not be able to submit documents on that day. In my experience, if you decide to take an appointment for family reunion, you normally get it after 4 to 6 weeks. So missing an appointment can be source of further delay.6. The interview by lawyer or at embassy may involve basic questions from your spouse about you. Newly married; make sure he/she has all the basic info about you.

7. Spouse of a Blue Card holder is exempted from providing A-1 German language certificate. About this, don’t believe on what they say on phone :). If your spouse can’t manage to do a language course in Pakistan, present following reference of the concerned Law  as proof on your appointment day:

8. In some cities, there were cases when Ausländerbehorde(ABH) objected that the spouse in Germany is passing through the probation period of job.  In some cities ,they ask for salary slips of 6 months while in others only for 3 months or just a job contract. Talk to other Pakistanis/Indians who have experience of dealing with the same ABH  so that you can proceed accordingly.

Please correct if I am wrong on any account. The info is based on posts of members on this forum, experiences of acquaintances and my personal experience.

    1. umer shab i have a question.humari city walo k sath aik problem ha..lawyer kissi sa passa mangta bhe nahi ha or report embassy ko bhajta bhe nahi ha….kiya karna chahya…sub k 6 months sa oper ho gaya ha time mager kissi ka visa nahi aya…call karta howa darta ha…kahi wo kuch ghalat na samja ager wo passa nahi chahta..hum ma sa aik na pouchta to kahta ha report bhaj de ha…mager visa abhi tak kissi ka nahi aya..baat karni chahya ya nahi..what is you openion…waiting for your suggestions.

      1. lawyer itni late report jama nhi kerwata,yeh embassy walay delay kertay hain,unhy embassy walay pay kertay hain verification k lia tu jitna jaldi verify kerwa k report jama kerway gy utni jaldi paisay miltay hain aur new case deti hai embassy,so i dont think so lawyer delay kerta hai usay paisay khila do tu report achi de deta hai embassy ko agar woh bol raha hai k us ny report send ker di hai tu theak hi bol raha,baki delay embasssy kerti hai aur us ka koi haal nhi

      2. Ye german walo ki tarf se delay ho sakta hai waha se jaise hi decision ata hai visa mil jata hai uss k kuch din baad yaha ka decision bhi ho jata hai aur iss mein city ka koi issue nahi hai

AoA umer bhai mere 5.5 months honay ko hai mujhay bei Lawyer n birth ka bola tha keh Union council aur nadra waly same Date p hone chaheye 2 Days wo peshawar m tha mujhay kaha y teek kerwalo kal tak .leken nadra walay keh rahay thy ye Impossible hai. Lawyer ko call keya keh nadra walay asay keh rahay hai. Pher us n kaha choro aur y puranii leke ao . Birth certificate k saath hum nay pasay bi deye keh kaam sahi hojaye. I Think wo pasay k leye esa keh raha tha. Birth ka problem to nhi hoga?

    1. Interview k doran wo keh raha tha buhat mushkel hai visa melna ye aur wo jab pasay deye to keh raha tha keh visa hojayega.

      1. asallam o alikum to all march applied visa april stupid lawyer call and asked me he want to verify my documents i said oki after week he call and asked me that can you please go to marriage office and pay them some money and asked them to verify your documents mainwhile i will come there i went there and pay money (rishwat) to that office for my own documents to be verified and than the stupid lawyer came and open his ugly diary and write report that this is fine and verified blah blah than this stupid lawyer asked oh can you go with me to birth office for verify this i said ok there they were lazy and this stupid lawyer asked again to pay some rishwat to these people so they can verify ( what on earth why i give money to embassy than and why the hell this stupid lawyer take his fees from embassy if he can not verify these things ? and this ugly lwyer make issue of birtt certificate even birth certificate was fine and office of birh clear everything than this stupid lawyer i am sorry but i will call him stupid because he was stupid so than this lawyer said to me your report is ok and he will submit in two days that two days weny into 6 month and this lawyer give report in 6 months when it was already done in 2 days and he gave negative report out of nothing these lawyers and local staff of pakistani people working for embassies are extremely jeloaus anyways i got my visa if he was negative mind lawyer , the other hand i got some very good people to help me out so in the end the truth win and negative mind people lose

        1. congrats :) inshAllah is month visa call b aa jay gi and do remember these points when you get the visa call
          1.take travel insurance with you,even they call and say just bring passport
          2.family visa is issued on tuesday or wednesday only so if they ask you to come on any other day ask them to reconfirm
          3.no need to worry about getting on time in embassy even if you get there by 8am you will probably get the visa by 11am or so,so just go there before 9am and wait

  7. 2 august ko apply kiya tha..mager abhi tak koie response nahi aya…august ma he lawyer visit kar gaya tha or september ma auslanderbehorde na document manga tha. auslanderbehorde bhe kah chuka ha k sub thk ha mager dar pata nahi kaha lag rahi ha.

    Applied on 13 July 2017
    Lawyer visited on 26 August 2017
    Ausländer Behörde invited me in Jan 2018
    Got visa 8.02.2018 Alhumdulliha

      24 july 2017 applied in embassy
      11 august 2017 lawyer visited and verified everything
      No contact from anywhere for 6 months
      25 jan 2018 visa call
      26 jan 2018 wife received a letter from abh saying they are happy to give me visa
      30 jan 2018 got visa issued

  16. AOA umer bhai aaj ABH n mere husband ko Office bhulaya tha . ABH n kaha keh hum n Aap ki Report thursday ko Embassy ok send ki thi. Aaj us n kaha keh aap ki wife n Embassy Call ki thi keh mujhay Visa nahi chaheye . Lekan me ne to blkl Call nhi ki thi . Abi me n Embassy ko call bhi ki thi lekan Koi responce nahi aye.     3. Forget about fast process what you can do just raise that objection n bhai aap aapna nadra ka certificate jo hai waha oer registrar kunsa hai aur urdu wala nikkah nama mein nakah khwan kunsa hai kindly ye check kere 2no same hai ya different

  21. mari wife k visa per objection lagaya ha k nikah khowan k signature nahi ha,
    Jab k nikah khowan k signature bhe ha or stamp bhe ha…
    Lawyer na masla kiya ha ya..
    ma na mail ke ha k stamp or signature ha ….circle kar k dekhaya ha k signature or stamp.

    ya objection k bad aulanderbehorde ma dobara documents jama karwana parta ha
    last november ma auslanderbehorde ha decission bhaj diya tha k everthing ok and we already sent agreement to embassy..
    kasa fast process karwa sakta ho ma after this objection..

    1. Abhi tak nahi hua judge holidays per tha now 23 date mili hai aap btao apka ho gaya hai kia btao aur aapko orders mil gae and aap ne age verification test bhi karwaya hai k nahi

Ager to aapki inquiry ho chuki hue hai then aap change na karwao jaha register hai wahe rehne do aap q k sometimes ye loog bolty hain but embassy does not object and seriously every inquiry man has his own rule because in my case my nikkah was registered in another uc where i don’t live and where nikkah was not taken palace but then ever embassy didn’t say anything.. so be cool and calm because to change nakkah from one uc to other uc is not easy you have to do it from court so its better let the process proced and embassy will not object because its normal you register your nikkah always where you or either your husband is living

    My wife got this reply from Embassy.
    “The Embassy regrets to inform you that your application for a family reunification visa can not be complied with. Her husband has none of the $ 30 para. I S. INr. 3 AufenthG residence permit. A visa is therefore only possible according to $ 30 para. 2 p. 2 AufenthG in discretion. The exercise of discretion granted to the mission abroad has led to the refusal of your visa application because your husband does not belong to any of the categories mentioned in 34 AufenthV. A special public interest in his stay in the Federal territory is not recognizable you have never lived with your husband and you according to the documents available to the Embassy only in the period 09.03.2017 to 18.04.2017, when your husband on the occasion of the marriage in Pakistan stopped when married couple got to know each other better. From a mutual familiarity as with married couples who have lived together for years, in your case can be no question. Her husband is only in Germany since September 2016, a relatively short period of time. Your application is therefore to be rejected.”

    I am a student. I have valid job and resident permit till January, 2019. And a valid residence for family according to rules.

    Can anyone please help me how do I proceed and what I should do now? Hire a lawyer or something??
    Please any help is very appreciable.

Walikum aslam uzair arif in your case you are only one year and 3 to 5 months in germany and you are student normally students are allowed only 20 hours per week so its parte time job if you have full time job Then ever you can’t invite your wife because you are less then 2 years in germany and you dont have permanent residence you are on study visa so you are not falling in that catogry and 3rd thing you were married and just stay with your only for one month together so you have not been in a very long term realtionship….i think so i am not sure but what i have seen in your matter this is the reason that your wife visa has been rejected
